Non-Indians don't like tribal rules

A non-enforceable moratorium on new construction has non-Indian residents on the Tulalip Reservation in Washington worried.

The ban was passed in response to high growth rates. But the tribe and local officials acknowledge it can't be enforced on non-Indians who own fee land.

The county has claimed jurisdiction over Indian fee lands within the reservation but the 9th Circuit Court of Appeals rejected that position last week in a unanimous decision.
