The state of South Dakota filed court papers on Monday accusing the Yankton Sioux Tribe of once wanting to develop land tribal members now seek to protect.

The state cited a 1996 development lease for a recreational area near the Missouri River. There was no mention of a burial ground, according to the court filing.

A tribal official said the plans were indeed drawn up but by those who weren't familiar with the site. Ellsworth Chytka pointed out that development never occurred. The contract also was canceled.
