Judge dismisses Indian veterans taxation suit

A federal judge in New Mexico has dismissed a lawsuit filed by Indian veterans whose wartime paychecks were taxed by the state.

A group of 15 veterans, mostly from New Mexico Pueblos, filed the suit against the U.S. Since their "home of record" was Indian Country, they say state income tax was illegally withheld from their checks.

But instead of seeking damages from the federal government, U.S. District Judge C. LeRoy Hansen said the veterans have to seek refunds from the state. The veterans plan to refile in New Mexico court.
