Judge strikes down one Native Hawaiian lawsuit
Friday, November 21, 2003
A federal judge this week struck down one lawsuit challenging programs for Native Hawaiians as two judges signaled they will issue ruling in separate cases.
On Monday, . U.S. District Judge Alan Kay ruled that the Native-only admissions policy at the Kamehameha Schools was valid. The school is private and does not receive federal funds, he said.
Also on Monday, U.S. District Judge Susan Oki Mollway heard oral arguments in a case challenging programs at the Department of Hawaiian Home Lands and the
Office of Hawaiian Affairs, two state agencies.
She indicated she would dismiss the claims against the home land office but allow the rest to continue.
In a third case challenging the school policy, the judge said he would rule in a couple of weeks.
