N.M. high court recognizes tribal sovereignty

The New Mexico Supreme Court has recognized the reach of Navajo tribal laws on allotted Indian lands.

Allotted lands are Indian Country and are subject to tribal law, the court recently ruled. Off-reservation companies that sell cars, mobile homes and furniture to tribal members who live on trust land have to go through tribal court when payments are in arrears.

The case was brought by a tribal member whose car was repossessed by an off-reservation company. Navajo tribal law does not allow repossession without a tribal court order or without the owners' consent.
