Woman sues over fall at Fallon Paiute Shoshone Tribe business

A woman in Nevada is trying to hold the Fallon Paiute Shoshone Tribe accountable for a fall at a tribally-owned business.

Becky McVay said she slipped on a wet floor at the Fox Peak Station in Fallon in August 2009. Since then, she has filed three lawsuits -- in state court, tribal court and federal court -- but all have been dismissed.

"There's no court for people to go to when they are injured on tribal property," her attorney, Nicole Harvey, told KRNV.

With her options running out, McVay is trying to keep her federal case alive. Her approach, however, is unusual -- in hopes of getting around the tribe's sovereign immunity, she is suing the tribe's insurance company.

A federal judge dismissed the case in April. McVay now wants the 9th Circuit Court of Appeals to hear the dispute.
