Kickapoo Tribe asserts concurrent jurisdiction over fatal accident

The Kickapoo Tribe of Texas is asserting jurisdiction over a fatal accident involving one of its members.

Raul Rodriguez, 35, is accused of intoxication manslaughter, driving while intoxicated and public intoxication. He allegedly struck and killed Adeline Hutson on December 11, 2010.

Tribal and state police are both investigating the incident. But a state sergeant said the land where the accident occurred is not held in trust.

"However, there may be nothing preventing the state from asserting its own jurisdiction as we claim concurrent jurisdiction," tribal administrator Don Spaulding told KSAT-TV.
