The state of New York won't be able to impose its tobacco tax in Indian Country while lawsuits are pending before the 2nd Circuit Court of Appeals.

The state is forcing wholesalers who provide tobacco to tribal retailers to pre-pay the tax. Tribes say the initiative violates their sovereignty and their treaties.

A federal judge has barred the state from collecting the tax although a preliminary injunction was not issued. However, the 2nd Circuit rejected a motion by the state to lift the ban.
