Judge orders acquitted suspect to testify in Aquash murder trial
A judge in South Dakota ordered Richard Marshall to testify in a trial for the the 1975 kidnapping and murder of American Indian Movement activist Anna Mae Pictou Aquash.

Marshall, a member of the Oglala Sioux Tribe, was acquitted in federal court for his role in the case. State prosecutors sought his testimony in the trial of John Graham, a Native man from Canada who is charged with Aquash's death.

Marshall has been offered immunity in state court for his testimony. He was worried that he still might face prosecution in tribal court but the judge noted that the statute of limitations for the Oglala Sioux Tribe has expired.

Jury selection continues today. Opening statements are expected tomorrow.

Thelma Rios, also Oglala Sioux, pleaded guilty for her role in the murder.
