Non-Indian landowner won't submit to Rincon Band jurisdiction
A non-Indian property owner is refusing to comply with the laws of the Rincon Band of Mission Indians in California.

Marvin Donius owns land that has been in non-Indian hands since the 1960s. He says his property isn't part of the reservation and that the tribe lacks authority to regulate the use of his property.

Donius filed a lawsuit in federal court to stop the tribe from asserting jurisdiction on his land. The case was dismissed because he failed to exhaust his tribal remedies.

The Intertribal Court of Southern California has ordered Dorius to remove materials from his land that it considers to be dangerous. Dorius refuses to comply so the tribe has blocked the entrance to his land with concrete barricades.
