Officials in Cayuga County and Seneca County in New York are moving towards an appeal in the Cayuga Nation tobacco tax dispute.

The counties raided two tribal smoke shops in November 2008. Earlier this month, the New York Court of Appeals, the state's highest court, said the counties lacked jurisdiction on Indian land.

Officials indicate they will ask the U.S. Supreme Court to hear the case. But a final decision by both counties hasn't been made.
