Osage Nation to appeal reservation status case

The
Osage Nation of Oklahoma will appeal a judge's decision that said the tribe's reservation does not exist.
The tribe claims all of Osage County as its reservation. But Judge James Payne said in a January ruling that "Congress and the courts have repeatedly recognized there are no reservations in Oklahoma."
The tribe asked Payne to reconsider his ruling but the request was denied on Monday. "Judge Payne’s most recent decision does not come as a surprise," Chief Jim Gray said. " We now can get on with our appeal.”
The case arose out of a dispute with the
Oklahoma Tax Commission. The tribe says members who live and work in Osage County shouldn't have to pay state taxes.
10th Circuit Decision:

Nation v. Oklahoma (December 26, 2007)
