2nd Circuit to hear Oneida Nation foreclosure case

The 2nd Circuit Court of Appeals will hear oral arguments on Tuesday over attempted foreclosures of Oneida Nation land.

The tribe has not paid property taxes on land in Oneida and Madison counties. The properties are within the tribe's original reservation but are not held in trust.

A judge ruled that the counties cannot foreclosure on the land due to tribal sovereignty. But the counties say the U.S. Supreme Court, in the Sherrill case, blocked the tribe from asserting sovereignty on ancestral land without going through the land-into-trust process.

The hearing takes place in New York City.
