Native women for matrimonial property laws

The Native Women's Association of Canada on Monday released a report calling for implementation of matrimonial real property laws on reserves.

Provincial marriage laws do not apply on reserves and federal Indian law is silent on divorces. That means a man can sell marital property, such as a house, without woman's consent.

"Matrimonial Real Property: A People's Report" proposes legislation to ensure Native women on reserves have the same rights as other women in Canada. NWAC also wants the government to create programs to help Native women who have been hurt by divorces.
