The South Dakota Supreme Court has adopted a rule to require the state bar exam to include an essay question on Indian law.
The essay will appear on the bar exam starting in July. The question will address basic principles of Indian law such as civil and criminal jurisdiction, the Indian Civil Rights Act, the Indian Child Welfare Act and the Indian Gaming Regulatory Act.
"In South Dakota today, one cannot enter and engage in the practice of law without knowledge of Indian Law. A client who seeks professional legal advice from an attorney should be confident the attorney is familiar with this increasingly important area of the law," Chief Justice David Gilbertson said.
Washington and New Mexico were the first two states to add Indian law to their bar exams.
