The Keweenaw Bay Indian Community of Michigan says a proposed sulfide mine will harm the environment.
The state Department of Environmental Quality gave preliminary approval to Kennecott Minerals to develop the mine. The site is located within the tribe's ceded territory.
"We have a great concern because of our 1842 treaty rights, our hunting, fishing and gathering rights," KBIC Chairwoman Susan LaFernier told The Houghton Mining Gazette.
The tribe has spent $700,000 in legal fees to fight the project. But the courts allowed the state to continue the permitting process for the mine.
A final decision will be made later this year.
