Company seeks to dismiss tribal Superfund lawsuit


A Canadian company accused of polluting the Columbia River is asking a federal court to dismissed a Superfund lawsuit filed by the Confederated Colville Tribes of Washington.

Tribal members want Teck Cominco to abide by an order to clean up the river. But the company says it is not subject to U.S. jurisdiction.

Teck Cominco's smelter plant is located in British Columbia but the company owns land in the U.S, according to the Environmental Protection Agency. The EPA says the plant is dumping lead, arsenic and other carcinogens into the river.
