South Dakota Supreme Court supports ICWA case
Friday, August 27, 2004
The South Dakota Supreme Court on Thursday ruled that a child welfare case involving a 2-year-old boy should be handled by the Crow Creek Sioux Tribe.
The boy's mother is a member of the tribe. She sought to have the case transferred to tribal court.
A state judge denied the request last year, saying the boy should go to his non-Indian father's grandparents. But the high court ruled yesterday that the Indian Child Welfare Act requires tribal jurisdiction.
