A gaming company that wants to open an off-reservation casino in the Catskills is still waiting to hear from the Bureau of Indian Affairs about an environmental assessment.
Empire Resorts has partnered with the St. Regis Mohawk Tribe to open the casino.
Their site in the Catskills previously won approval from the BIA under the two-part determination process.
The BIA has since said the two-part approval is still valid. But Empire says the BIA still hasn't determined whether the environmental assessment is sufficient.
